Booking offers and price references
Pursuant to current legislation, in particular Act 34/2002 on information society services and e-commerce, in the section for confirming the booking, CLEMENT HOTELES SL provides information about all possible bookings, including their features and prices. However, CLEMENT HOTELES SL reserves the right to withdraw, replace or change offers made to customers through its website, by simply changing the content thereof. Accordingly, the products and/or services offered from time to time by the CLEMENT HOTELES SL website shall be governed by the General Terms and Conditions in force from time to time. Furthermore, the company shall have the ability to cease to offer the aforementioned products and/or services at any time, without prior notice.
Every booking option offered shall indicate its price and whether or not it includes VAT or any other applicable tax, as the case may be. The prices indicated on the screen shall be correct at that time, except in the case of any typographical errors. If the price is different for the above reason, CLEMENT HOTELES SL will communicate said situation to the customer, via email, before proceeding to charge the booking.
Availability of the offers made by CLEMENT HOTELES SL through its website may vary depending on customer demand. Although CLEMENT HOTELES SL regularly updates its database, the booking requested by the customer could be full at the time of request. In this case, CLEMENT HOTELES SL will send an email to the customer informing them that the offer is no longer available.
On its website booking page, CLEMENT HOTELES SL requests credit card details and the name of the person booking, in order to process said booking. We remind you that the establishment does not charge anything to your credit card at the time of making the booking. The card is only used as a guarantee. The establishment reserves the right to check the validity of the credit card before the customer arrives. The corresponding invoice for the booking will be directly issued in the establishment, whether it is paid by cash, credit card, or any other payment method accepted by the hotel.
Check In/Check Out
Check in is subject to availability as from 12:00 noon and is guaranteed as from 1:30 pm onwards, on the first day of the booking. You must check out before 12:00 noon, at the very latest, on the last day of the booking.
GENERAL CONDITIONS OF CONTRACT
These General Conditions of Contract shall regulate expressly the relations arising between CLEMENT HOTELES SL and the Users who may contract the provision of the services offered through the Portal.
The present General Terms have been prepared in accordance with the Law 34/2002, on the information society and electronic commerce, the Law 7/1998 on General Terms of Sale, the Legislative Royal Decree 1/2007, of 16 November, which approved the consolidated text of the General Law on the RIghts of Consumers and Users and other complementary laws, the Law 59/2003, of 19 December, on digital signatures, and such other legal provisions that may be applicable.
This document is accessible at all times in the online purchasing section of the Portal of CLEMENT HOTELES and may be printed and stored by the User.

AT THE CONSUMER´S REQUEST

Pursuant to the provisions of Section 103 of Act 3/2014, of 27 March, that modifies the recast text of the General Consumers and Users Protection Act, the supply of goods and services compiled according to consumer specifications, clearly personalised or that, due to their nature, cannot be returned, or could deteriorate or expire quickly, are exempt from any right to contractual withdrawal.
In accordance with the stipulations of the current personal data protection regulation, we advise that your data will be incorporated into the processing system owned by CLEMENT HOTELES SL, with V.A.T. No. B84183599 and its registered office situated at AVENIDA GENERAL 43 28042, BARAJAS DE MADRID (MADRID, SPAIN), for the purpose of facilitating, assisting with and fulfilling the agreements established between both parties. In compliance with the current regulation, CLEMENT HOTELES SL advises that the data shall be stored for the period strictly necessary to comply with the aforementioned concepts.
CLEMENT HOTELES SL advises that it shall process the data in a legal, fair, transparent, appropriate, relevant, limited, exact and up-to-date manner. For this reason, CLEMENT HOTELES SL hereby undertakes to adopt all reasonable measures to remove or rectify, without delay, any inaccurate data.
In accordance with the rights conferred on you by the current legislation on personal data protection, you may exercise your rights to access, correction, limitation, erasure, and portability of your personal data, and to object to the processing of said data, as well as whether or not to grant consent to said processing, by writing to the postal address indicated above, or to the email address INFO@CLEMENTHOTELES.COM.
You can also submit a claim to the pertinent Control Authority if you deem it appropriate.
APPLICABLE LEGISLATION AND JURISDICTION
Furthermore, CLEMENT HOTELES SL hereby reserves the right to file any civil or criminal actions it deems appropriate for misuse of its website or content, or for any breach of these terms and conditions.
The relationship between user and service provider is governed by current regulations applicable in Spain. In the event of a dispute, the parties may submit their claims to arbitration or the ordinary jurisdiction, in compliance with the regulations regarding jurisdiction and competency for said purposes. CLEMENT HOTELES SL has its registered office situated in MADRID, Spain.
GENERAL TERMS AND CONDITIONS FOR BOOKING
These General Terms and Conditions for Booking (hereinafter, the “General Terms”) shall govern the commercial relationship established between CLEMENT HOTELES SL and the user or customer by way of the contract entered into by completing the forms that CLEMENT HOTELES SL provides via WWW.CLEMENTHOTELES.COM.
These terms shall be applicable without prejudice to the application of any applicable legal regulations, on a case by case basis.
The General Terms and Conditions of Contracting shall govern the distance selling relationship between CLEMENT HOTELES SL and the user or customer, in accordance with legal stipulations, and in particular the provisions of the General Terms and Conditions for Contracting Act 7/1998, of 13 April, Act 3/2014, of 27 March, that modifies the recast text of the General Consumers and Users Protection Act, the current Personal Data Protection Regulation, the Retail Trade Management Act 7/1996, of 15 January, and the Information Society Services and E-Commerce Act 34/2002, of 11 July.
CLEMENT HOTELES SL hereby reserves the right to make any amendments it deems appropriate to its General Terms, without prior notice. Said amendments can be made through its websites, by any means admissible at law, and compliance with them shall be obligatory for the period during which they are published online and until such time as they are legitimately amended in the future. However, CLEMENT HOTELES SL hereby reserves the right to apply, in particular cases, some Special Terms of Contracting, that shall take precedence over these General Terms, as and when it deems appropriate, and provided that said terms are notified in the required time and form.
Information prior to booking
CLEMENT HOTELES SL advises that the booking process through its online pages is detailed in the appropriate section for confirming the booking.
Once the booking is complete, the user will see the confirmation on the screen, with the option of printing the page to use as proof of booking.
The booking confirmation and proof of booking (printed by the user) shall not constitute a valid invoice.
Pets or companion animals are not permitted.
CANCELLATION POLICY STANDARD BOOKING
To complete the booking you need to provide your personal details and your credit card details as a payment guarantee. Payment will be effected at the hotel. Cancellation is allowed free of charge until 6:00 pm on the day of arrival. In the event that you cancel the booking after this time, or in the case of a no-show, we will charge the amount for one night to your credit card and cancel the booking.
CANCELLATION POLICY NON-REFUNDABLE BOOKING
Booking terms for non-refundable rooms are different to the hotel’s general terms and conditions. The full amount of the stay will be charged at the time at which you confirm the booking. This fee is non-refundable and cannot be amended. In the event of cancellation, the amount will not be reimbursed.
Credit cards (non-refundable bookings)
Non-refundable bookings are paid for at the time of making the booking. By pressing CONFIRM BOOKING you are sent to the BancSabdell secure payment gateway to complete the booking and make the payment.
PayPal (non-refundable bookings)
Non-refundable bookings can also be paid for via PayPal.
